of monkeys and coconuts....

If I have not said enough, taking on credits for a subject is a great way of forcing us to do a lot of reading and mulling; especially when I do not have the discipline, when I am left on my own.

The babylonian golahs produced a lot of poetic literature. Similarly, during this period of dissonnance, here is another one example of 'literature', coming out of our Perak fiasco....

Umno's insistence on holding on to Perak at any cost despite the harm done to it reminds me of how monkeys can be caught by using their greed.

A hole is made in a young coconut just large enough for the monkey's hand to pass through. The coconut is emptied of its juice and a few pieces of fruit or nuts placed inside. It is left where the monkey can see it.

Soon a monkey will come down and investigate. When it reaches in, it will grab the food. If the hole is the correct size, the monkey's hand can go in but will not come out with its fistful of food.

The monkey can then be approached and is at your complete mercy. The coconut weighs it down and prevents its escape although all the monkey has to do is to let go of the food.

Does this remind you of Umno holding on to Perak?

I am FREE.....

after a minor hiccup over the last few days.....
I am done! I am done with my MCowS...
I am finally, finally FREEEeeee.... ! phew!
Yes I am Soooooooooo, sooooo, FREEEeeee....

(well, at least for a while, sigh! because People
and I mean People, got plans for me!!)

I have not learnt how to insert videos etc ....
But the song of the old turkey Buzzard is so appropriate.
and if you are young enough, you will know the song too...

The last time I felt like this was when we were doing

confined in a rickety old bus - for hours
At the very next stop, which happens to be facing
a field of flowering sunflowers
as far as the eyes could see ...
I closed my eyes and imagined myself
running freeeeee... skipping... hopping....
all the way to the clear blue sky ...

So now you know how
imprisoned
deprieveing
it has been...

See what ambition does to one
for a calling does not call for such 'suffering'...???

So for the next few days, I will indulge in 'deep soul sleep'..
don't call me...
till I am done .....
dreaming of the above....

.. in exile.... May 14

Now that we have just finished Exile...
this piece of news, which came out in the 'today in history' suddenly has significance....

"State of Israel Proclaimed (1948)
In November 1947, the UN approved the Partition Plan for Palestine, calling for the formation of two states, one Jewish and one Arab, as well as a small, internationally administered zone in what had previously been a British-administered territory. I believe it is just Another example of how Man interprets God's will... or the Law. Take a moment off and compare it with ... this..

'what are you staying...'

This is an email sent to me. I think it is one brilliant article written by one Art Harun —( www.art-harun.blogspot.com). He claims to be "a failed government experiment, abandoned and left alone to roam the streets after all remedial efforts yielded no positive result".

Hence I have copied enbloc the whole article here....

What are you staying? — Art Harun
MAY 13 — There was a man. His name was Muthu. He married Meenachi. All those time he was feeling uneasy. He was not attracted to Meenachi. But he had to marry her because it was arranged. In fact, he wasn't attracted to any woman. Muthu felt that he was actually a woman trapped in a man's body.

So, he finally summoned enough courage and underwent a sex change. He took whatever hormones pills to make his skin smooth. Removed his penis. Implanted silicon into is chest and grow them up to a pair of C cuppers.

Then he went to court. And asked for a declaration that he was and is a woman. He also asked for a divorce. Meenachi objected. Some NGO, claiming to represent some rights group, intervened and objected too. Some family members also objected.

After a lengthy hearing and hearing submissions from eminent and not-so-eminent counsel, the court granted a declaration that Muthu is and was at all material times a woman. Muthu was very happy. He celebrated. At last, he was free from the constraint of being labelled a man when he is in fact a woman.

Or so he thought.

His wife appealed. The NGO also joined in. His family members as well. While waiting for the appeal, his wife asked the Court of Appeal for an order staying the declaration which Muthu had earlier obtained in the High Court.

Despite the fact that there were two other sittings of the Court of Appeal that day, where a full coram of three Court of Appeal judges were sitting in each of the two sittings, Meenachi's application for a stay order was heard by a single judge. But Muthu did not say anything. Because under the law, a single judge could hear such application.

The single-judge Court of Appeal, after hearing submissions, granted an order staying the declaration which Muthu had earlier obtained.

Muthu now has a problem. She has been declared a woman. She behaves like a woman. Dresses like one. She's got C-cup boobs. And she has no dick. When she wants to go to the loo, she would want to go to the ladies loo. In fact that is the primary reason for obtaining the declaration. She wants to be able to go to the ladies’ toilet without committing an offence under some municipal regulations.

But now the declaration is stayed. What does that mean? Does it mean that Muthu is not a woman? But the court has declared so. In law she is a woman. How? Does it mean now that Muthu cannot go to the ladies’ toilet? She doesn't want to go to men's toilet. What would the men say? Or do? She has boobs. Wears skirt. No dick. Some men might just smile. Some might take it the wrong way. Some might molest her in the men's toilet. How?

And does it mean now Muthu also cannot behave like a woman? Must she now wear pants and scratch the area where her balls used to be, like other men? And drink beer from the mug in one gulp? And burp loudly after that? Must she also pee while standing? When she is in Kelantan, which supermarket lane is she supposed to be in? Male or female? Muthu is confused. She really doesn't know what to do. How is she supposed to behave now?

Muthu consults her lawyers. Her lawyers say a declaration cannot be stayed. How can a declaration be stayed? You can stay the execution of a judgment or order. Meaning, if the court gives an order saying Meenachi owes one million to Muthu, the court can stay the execution of that order. When that kind of stay is given, it means that Muthu cannot do anything to recover that one million until Meenachi's appeal is heard and decided upon. But in that case, it is still an accepted fact that Muthu is a holder of an order requiring Meenachi to pay one million to Muthu. That order is not reversed. It is valid. The only thing is that Muthu cannot recover that one million just yet. Until Meenachi's appeal is heard and decided upon, that is.

But Muthu did not get that kind of order. Muthu obtained a declaration that she was and is a woman. How do you stay that kind of order. Stay what? To stay that kind of declaration would tantamount to the Court of Appeal reversing the declaration which the High Court had granted after full adjudication. That couldn't be. How can the Court of Appeal do that without hearing the appeal on the merit?

To do such thing would tantamount to the Court of Appeal not recognising the High Court order. The Court of Appeal surely cannot do that. In the hypothetical case of the one million order above, the court does not invalidate that order. The court just suspends Muthu's right to recover the one million. The court recognises the validity of the order but the court says Muthu should not recover the one million for the time being.

But to stay a declaration is a different game. That is like saying that declaration does not exist for now. So, Muthu is, for the time being, a man.

Muthu is thinking of wearing black all the time.

P.S: Just as a digression. On the Nizar vs Zambry declaration, I was thinking. Under section 54 (d) of the Specific Relief Act 1950, no injunction shall be granted to, among others, interfere with the public duties of any department of any government in Malaysia. Nizar has been declared the Mentri Besar of Perak. Now, the stay which was given operates or at least is intended to stop him from carrying out his duties as the MB of Perak. It operates as an injunction of sort.
Wouldn't section 54 apply?

we need to celebrate !!!

We need to celebrate this day - this 40th anniversary of May 13.

Why?

First and foremost - some one quoted to my face Che Guvera. Hei, I know him you know! Once upon a time, during my college days, far far away, the last thing I see, every night, is a poster of his face right across my bed. But Che and those memories belong to yester-years.

From then till today, I belonged to a generation that benefited from “the processes of globalization and the ‘high-tech’ modernisation associated particularly with the governments of Mahathir are increasingly being seen as the main drivers of identity reformulation in Malaysia, particularly amongst the Malays”. (Graham K Brown, The formation and management of political identities: Malaysia and Indonesia compared, Centre for Research; on inequality, human security and ethnicity, CRISE, Queen Elisabeth House, University of Oxford, www.crise.ox.ac.uk/pubs/workingpaper10.pdf)

Though we benefitted economically, politically, most of our generation are (I am) ostriches, with our head in the sand. Maybe I have had been mixing with the wrong crowd. At least my crowd do not mention Che's name, neither do I talk about Che in my very middle class, middle aged crowd. So don't you think we should celebrate that there are 'young' Anak Bangsa Malaysia who knows Ernesto Che Guevera?

Yes, the Perak State government is still in a bit of a shambles. Give it time. Have faith! Be vocal if nothing else; because we cannot let history repeats itself!

Meanwhile 40years down the road, don't you think:
- We must recognise that it is not quite so convenient to slap the ISA down our throat.
- We must celebrate that there are 'mighty man' in Malaysia who would risk political, economic and personal freedom.
- We must celebrate that we are maturing politically as a country.

we are growing up

KUALA LUMPUR:(Star newspaper) The High Court here ruled today, Monday, 11th May 2009, that Datuk Seri Mohammad Nizar Jamaluddin is the rightful Perak Mentri Besar, and not Barisan Nasional’s Datuk Seri Dr Zambry Abdul Kadir.
In an immediate response, Zambry said he would apply for a stay pending appeal. This was rejected by the court.
Nizar left the courtroom immediately after a press conference to travel to Ipoh where he will seek an audience with the Sultan of Perak, Sultan Azlan Shah, to get his consent to dissolve the Assembly and call for fresh state elections.
In his ruling Monday, Justice Abdul Aziz Abd Rahim said that a new mentri besar could not be appointed as the office had not been vacated

Kudos! to Justice Abdul Aziz Abd Rahim for
- his Integrity in the ruling
- his Guts to stand up for what is right
We must all pray that Allah will bless and protect him and his family
